The terms of use (“Terms”) contained herein govern the use of services (“Services”) provided by all platforms affiliated with CAMPUSX SOCIAL TECHNOLOGIES PRIVATE LIMITED (“Campus X”, “we”, “us”, “our”) an Indian Company with its registered office at PLOT NO.195 HANUMAN VATIKA-A GOKULPUR JAIPUR JHOTWARA JAIPUR-302012 RAJASTHAN including but not limited to the Website, the application (Appstore, Playstore), Twitter handle, (collectively referred to as the “Platforms”), effective from 11th June 2024 (“Effective Date”)
These terms are binding on the Users of Campus X (“you”, “your”, “User(s)”) which includes any person or entity who accesses, registers, downloads, browses, or uses in any form, general or specific, the Services provided by Campus X, through its Platforms. Please read them carefully before using the Services provided by Campus X on all of our platforms.
The User acknowledges and agrees that the User has read the Terms carefully, understands its meaning and intent, and is aware and accepting of all the Terms contained herein and the Campus X Privacy Policy [link] before using the Platforms. If the User does not agree to the Terms or perform any/all obligations accepted under the Terms, then the User may not access or use the Services or the Platforms of Campus X.

Definitions and interpretation
1. “Action”means any claim, action, cause of action, demand, lawsuit, arbitration, inquiry, audit, examination, a notice of violation, proceeding, litigation, citation, summons, subpoena, or investigation of any nature, civil, criminal, administrative, regulatory or otherwise, whether at law or in equity.
2. "Affiliate(s)"means any person or entity directly or indirectly, employed or engaged on a contractual basis, or in any other similar way related to Campus X.
3. "Applicable Law(s)"means any and all applicable substantive and procedural laws including but not limited to, the Laws of India and other relevant laws applicable to the User(s).
4. "Content"means any creation written, drafted, posted, sent, or delivered by any of the Users of the Platform.
5. "Campus X Account"means the login account of the User created with Campus X for the use of its Services.
6. "User"may refer to any person (individual or otherwise) who engages with the Campus X Platforms;
7. "Visitor"shall include lurkers, visitors and/or readers who inter-alia browse, read and watch content provided by Campus X.
Scope
1.
Campus X provides a platform for Students to discuss and propagate ideas about their campus and workplaces. The Users have the ability to use the platform independently and anonymously. Campus X acts as a social media intermediary platform to provide these Services.
2.
The User details are encrypted by a hashing mechanism, and cannot be reverse-engineered to extract the User’s details from the Platform. Campus X is not liable for any Content on the Platforms that have been produced by any of its Users.
3.
If any User of the Platform posts or delivers any Content which may contain or seem to contain any false, unpublished price-sensitive, harmful information, no liability for the same shall be attributable to Campus X. Campus X has no control or censorship over the Content produced by its Users. Further, Campus X maintains the absolute anonymity of its Users. Thus the Platform or its Developers may be unable to track down the identity of any of its anonymous Users.
Privacy
We are committed to protecting your privacy. Campus X does not store any data (such as your phone number or email address) that lets us or any other third party identify your real identity.
1.
Campus X’s privacy policy (Campus X privacy Policy) describes how the information that the User provides to us when they use our Services, is handled. By using our Services, the User consents to the collection and use of their data as set forth by the privacy policy.
2.
It is the responsibility of the User to keep their device and access to Campus X’s Platforms secure. It is recommended that the User should not jailbreak or root their device, which is the process of removing software restrictions and limitations imposed by the official operating system of their device. It could make the User’s device vulnerable to malware/viruses/malicious programs, and compromise the said device’s security features. It could mean that the Campus X Platforms won’t work properly or at all.
User eligibility
1.
The User accessing the Campus X Platforms hereby represents and warrants that the User has completed the age of majority in their jurisdiction or eighteen (18) years of age and is competent to enter into the terms, conditions, and obligations set forth under these Terms.
2.
Any User below the age of Eighteen (18) is not permitted to engage with Campus X.
3.
The User shall not be eligible for using the Services if the User is located in, or is a citizen or resident of any state, country, territory, or other jurisdiction where the use of the Services would be illegal or otherwise violate any applicable laws.
4.
Where an account is created for a legal entity that is not a natural person, the User represents that they have full authorization and legal authority to accept the present Terms of Use on behalf of the said legal entity.
5.
The User may be required to create an account to use the services provided by Campus X. The User shall not make any username that breaches the User Code of Conduct under these Terms while choosing their username.
Basic use requirements
1.
The User shall require a compatible mobile phone, internet, or any other supported devices ("Devices") and enabling facilities that meet certain system and compatibility requirements, which may change from time to time, to use the Services.
2.
The User’s ability to use Campus X and the performance of Campus X Services may be affected by these factors. The User agrees that the User is solely responsible for such requirements, including any applicable charges, updates, fees, and all other terms provided under the User’s agreement with their Devices and/or telecommunications provider. Campus X shall not be responsible for any lapse of security due to internet issues or issues with the Device(s).
3.
Our Services are currently available on Android & iOS. The requirements for both systems(and for any additional systems we decide to extend the availability of the app to) may change, and the User will need to download the updates to keep using our Services. Campus X does not promise that it will always update its Services and therefore, the User is responsible to ensure that the system requirements of their device are compatible with the use of our Services. The User also represents to always accept updates when offered to You by Campus X.
User code of conduct
1.
Obligations and Prohibited Actions:
a.
The User shall not use any material that is false, offensive, harmful, obscene or pornographic, hateful, defamatory, libelous, derogatory, abusive, threatening, or in any other way illegal or infringing upon the legal rights of others, in violation of this clause.
b.
The User shall not impersonate any other natural or legal person, use their identification or contact details, create accounts in their name, or falsely state or misrepresent any association or affiliation with such persons.
c.
The User shall only maintain one account reflecting their true identity and profile history.
d.
The User shall not post any Content which may contain any Unpublished Sensitive Information. If any such Content is posted by a User, there shall be no liability attributable to the Platform. The Platform and its Affiliates have no duty to censor or delete such Content. However, Campus X may, in its discretion, choose to censor such Content once the existence of such Content has been brought to their notice at their absolute discretion.
e.
Users shall be civil and respectful of other Users and shall not display any deliberately unpleasant, repetitive, or irrelevant behavior;
f.
Users shall not reveal identifiable information about other Users of Campus X unless explicitly permitted by them to do so;
g.
Users shall not use or solicit another party to use Campus X Platforms, directly or indirectly, for any purpose which is prohibited by their applicable law, rule, regulation or guideline.
h.
The User shall not interfere with security-related features of the Platforms, including but not limited to
i.
disabling or circumventing features that prevent or limit use or copying of any content; or
ii.
reverse engineering or otherwise attempting to discover the source code of any portion of the Platforms except to the extent that the activity is expressly permitted by applicable law. Any attempt at such interference shall attract a ban from the Platforms and other actions.
iii.
develop, support, or use software, devices, scripts, robots or any other means or processes to scrape the Services or otherwise copy profiles and other data from the Service.
i.
Users are account holders. You agree to: (1) use a strong password and keep it confidential; (2) not transfer any part of your account and (3) follow the law and Code of Conduct. You are responsible for anything that happens through your account unless you close it or report misuse.
j.
The User shall not collect, generate, or affect in any way usernames or email addresses using bots or any other methods or sell or transfer the User profile to any person or entity.
j.
The User shall not use or solicit another party to use Campus X or its Platforms, directly or indirectly, for any purpose which is prohibited by applicable laws, rules, regulations, or guidelines and/or is in violation of this clause.
2.
The User shall not monitor the Services’ availability, performance, or functionality for any competitive purpose.
3.
The User shall not use bots or other automated methods to access the Services, add or download contacts, or send or redirect messages.
4.
The User shall not violate the intellectual property rights of others, including copyrights, patents, trademarks, trade secrets or other proprietary rights.
5.
The User shall not violate the intellectual property rights of Campus X, including but not limited to, copyrights, patents, trademarks, trade secrets, or other proprietary rights.
6.
The User shall not license, sell, or transfer their Account without the written approval of Campus X.
7.
The User is granted a personal, non-transferable, non-exclusive, revocable, limited license to (a) install and use a copy of the Campus X application associated with the Services that is obtained from a legitimate marketplace on a mobile device owned or controlled by the User; and (b) access and use the Services. All rights not expressly granted to the User by these Terms are reserved in favor of Campus X.
8.
By submitting, posting, or displaying Content on or through the Services, You grant Campus X a worldwide, non-exclusive, royalty-free license (with the right to sublicense) to use, copy, reproduce, process, adapt, modify, publish, transmit, display, and distribute such Content in any and all media or distribution methods now known or later developed (for clarity, these rights include, for example, curating, transforming, and translating). This license authorizes Campus X to make your Content available to the rest of the world and to let others do the same. You agree that this license includes the right for Campus X to provide, promote, and improve the Services and to make Content submitted to or through the Services available to other companies, organizations, or individuals for the syndication, broadcast, distribution, promotion or publication of such Content on other media and services. Such additional uses by Campus X, or other companies, organizations, or individuals, are made with no compensation paid to the User with respect to the Content submitted, posted, transmitted or otherwise made available through the Services as the use of the Services by the User is hereby agreed as being sufficient compensation for the Content and grant of rights herein.
9.
Except and solely to the extent such a restriction is impermissible under applicable law, the User may not, without a written agreement with Campus X or any of Campus X affiliates (a) license, sell, transfer, assign, distribute, host, or otherwise commercially exploit the Services or any content on the mobile application; (b) modify, prepare derivative works of, disassemble, decompile, or reverse engineer any part of the Services; or (c) access the Services or Content in order to build a similar or competitive website, product, or service
10.
The User represents and warrants that they have obtained all rights, licenses, consents, permissions, power and/or authority necessary to grant the rights granted herein for any Content that you submit, post or display on or through the Services. You agree that such Content will not contain material subject to copyright or other proprietary rights, unless you have necessary permission or are otherwise legally entitled to post the material and to grant Campus X the license described above.
11.
The User shall not post anything that contains software viruses, worms, or harmful code.
User content
1.
The Services provided by Campus X may contain information, text, links, graphics, photos, videos, audio, streams, or other materials (“Content”), including Content created with or submitted to the Services by the User or through the User’s Account (“Your Content”). Campus X takes no responsibility for and Campus X does not expressly or implicitly endorse, support, or guarantee the completeness, truthfulness, accuracy, or reliability of any of Content produced by the User.
2.
The User retains any ownership rights they have in the Content produced by them, but You grant Campus X the following license to use that Content:
a.
When User Content is created with or submitted to the Services, the User grant Campus X a worldwide, royalty-free, perpetual, irrevocable, non-exclusive, transferable, and sub-licensable license to use, copy, modify, adapt, prepare derivative works of, distribute, store, perform, and display such Content and any name, username, voice, or likeness provided in connection with such Content in all media formats and channels now known or later developed anywhere in the world. This license includes the right for us to make such Content available for syndication, broadcast, distribution, or publication by other companies, organisations, or individuals who partner with Campus X. The User also agrees that Campus X may remove any data or metadata associated with Content produced by the User and that the User irrevocably waives any claims and assertions of moral rights or attribution with respect to their Content.
Third-party content and services
1.
The User may interact with third parties applications and . Campus X may integrate such third-party applications such as Telegram, Instagram, Youtube, Twitter or Discord and/or similar apps with their Platforms for User convenience.
2.
Such Third Party applications are not under the control of Campus X, and Campus X is not responsible for any third party’s websites, products, or services. The User’s use of Third Party applications, products, or services is at their own risk and the User should make an endeavor to make any investigation they may feel necessary before proceeding with any transaction in connection with such Third Party applications, products, or services.
3.
Campus X shall not be responsible for examining or evaluating the content, accuracy, completeness, availability, timeliness, validity, copyright compliance, legality, decency, quality, or any other aspect of third-party materials or websites.
4.
The use of third-party services is governed by their respective terms of service and not by these Terms. The User bears the sole and exclusive responsibility of accepting and complying with their respective terms of service, fees, and charges.
5.
Campus X does not warrant, endorse, or assume any responsibility for third-party materials and shall not have any liability to the User or any other person for any third-party services, websites, or other materials or products.
6.
The User may incur charges or fees from third parties for the use of third-party services. Campus X receives no part of such charges and shall under no circumstances incur any liability arising out of or relating to such third-party charges.
Assumption of risk
The User acknowledges and accepts the following:
1.
Campus X services may be subject to technological interference, including but not limited to, downtime on any third-party platform accessed by the User via Campus X, or its Platforms, network uptime, and network interference.
2.
Any use or reliance on any Content or materials posted via the Services or obtained by the User through the Services is at their own risk. Campus X does not endorse, support, represent or guarantee the completeness, truthfulness, accuracy, or reliability of any Content or communications posted via the Services or endorse any opinions expressed via the Services. You understand that by using the Services, You may be exposed to Content that might be offensive, harmful, inaccurate or otherwise inappropriate, or in some cases, postings that have been mislabeled or are otherwise deceptive.
Indemnification
1.
The User agrees to indemnify Campus X, all its Affiliates, and their respective, directors, officers, employees, affiliates, agents, contractors, third-party service providers, and licensors, from any claim or demand made by any/all third parties, arising out of -
a.
User’s use of Services;
b.
User’s breach of the Terms;
c.
Misuse of any service provided by Campus X and/or Platforms;
d.
Violation of any laws, rules, regulations, codes, statutes, ordinances, or orders of any governmental or quasi-governmental authorities;
e.
Violation of any rights of third parties, including but not limited to intellectual property, confidentiality, privacy, and/or publicity;
f.
Any misrepresentation of fraud on the part of the User.
2.
Campus X reserves the right to assume, at the User’s expense, the exclusive defence in any matter subject to this clause and indemnification by the User.
3.
The User agrees to cooperate with Campus X’s defence of any claim under this clause and the User shall not, in any event, settle any claim, without the prior written consent of Campus X.
Term and termination
1.
The Terms are effective from the Effective Date and shall remain in force until terminated under this clause.
2.
Campus X reserves the right to terminate the User from using its Platforms without prior notice or liability if the User is found to be in breach of these Terms.
3.
In the event of such termination, Campus X shall not be liable for any loss of information, damage, or any other loss of similar nature.
4.
The User may request the termination of their account by contacting Campus X. Upon completion of such request, the User’s right to use the Platforms ceases.
5.
Campus X reserves the right to discontinue or terminate Campus X for all Users without placing any liability on the User. In the event of such termination, not resulting out of a violation by the User, Campus X may notify the User regarding the same.
Limitation of Liability
1.
Campus X or its Affiliated Parties and their respective, directors, officers, employees, affiliates, agents, contractors, third-party service providers, and licensors, shall not be liable under any circumstances for any lost profits or any special, incidental, indirect, or consequential damages, whether based on contract, tort, negligence, strict liability, or otherwise, arising out of or in connection with these Terms or otherwise even if an authorized representative of Campus X has been advised or should have known of the possibility of such damages.
2.
Campus X or its Affiliated Parties and their respective, directors, officers, employees, affiliates, agents, contractors, third-party service providers, and licensors, shall not be liable for any non-payment or failed transaction by a Fiat Gateway. Any transaction or agreement through the Platform shall be treated as a separate agreement between the User and the Fiat Gateway, with no liability attributable to the Platform.
3.
We only agree to perform such duties as are expressly set forth in these Terms, and no other duties will be implied. We have no liability under, and no duty to inquire as to, the provisions of any agreement, other than the Terms of Service.
4.
The User understands and agrees that, to the fullest extent permitted by applicable law, neither Campus X, its Affiliates nor or its Affiliated Parties and their respective, directors, officers, employees, affiliates, agents, contractors, third-party service providers, and licensors, shall be liable to the User for any direct, indirect, incidental, special, punitive, exemplary or other damages of any kind, including but without limitation to damages for loss of profits, goodwill, or other tangible or intangible losses or any other damages. This includes but is not limited to:
a.
any damage, resulting from the Platforms;
b.
conduct of any third party on the Platform;
c.
any actions taken by Campus X or failure thereof;
d.
human errors or technical malfunctions;
e.
any loss, damage, or injury, direct or indirect arising out of forgotten passwords, server failure, malfunction, misuse of service, or intangible losses;
f.
inability to fully access the Platforms or use the Services;
g.
any conduct or content of any user on the services, including without limitation, any defamatory, offensive or illegal conduct of by the users and any content obtained from the Services; or unauthorized access, use or alteration of Your transmissions or content;
h.
the introduction of viruses, worms, or other destructive programs or any other commercial or economic losses; any decision made or action taken by any party in reliance on Campus X’s data that is processed late or incorrectly or is incomplete or lost.
5.
Campus X is an intermediary as defined under the Information Technology Act, 2000 and the Information Technology (Intermediary Guidelines and Digital Media Ethics Code) Rules, 2021. These Terms are published in accordance with the provisions of Rule 3(1) of the Information Technology (Intermediary Guidelines and Digital Media Ethics Code) Rules, 2021 that require publishing of the rules and regulations, Privacy Policy, and Terms of Use for accessing and using our Platform. Our role is limited to providing a platform for Users to upload, share and display content, created or shared by You and other Users. Campus X does not control what Users may post on the platform but Users shall comply with our Community Guidelines.
Disclaimers
1.
CAMPUS X DOES NOT MAKE ANY REPRESENTATIONS OR WARRANTIES. THE SERVICES ARE PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS. CAMPUS X AND/OR ITS SUBSIDIARIES, AFFILIATES, RELATED ENTITIES, AGENTS, REPRESENTATIVES, PARTNERS, LICENSORS, OR ANY SUCH RELATED PARTY TO CAMPUS X(COLLECTIVELY, “INDEMNIFIED PARTIES”) MAKE NO GUARANTEES OF ANY KIND IN CONNECTION WITH THE SERVICES PROVIDED BY CAMPUS X OR BY ANY OF ITS USERS.
2.
CAMPUS X AND ALL INDEMNIFIED PARTIES DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, RELATED TO ANY/OR ALL MATERIAL, CONTENT, OR SERVICES MADE AVAILABLE BY CAMPUS X OR THE PLATFORMS OF CAMPUS X INCLUDING BUT NOT LIMITED TO (A) ANY IMPLIED WARRANTY OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, QUIET ENJOYMENT, OR NON-INFRINGEMENT; AND (B) ANY WARRANTY ARISING OUT OF COURSE OF DEALING, USAGE, OR TRADE.
3.
CAMPUS X DOES NOT WARRANT THAT THE SERVICE OR ANY PORTION OF THE SERVICE, OR ANY MATERIALS OR CONTENT OFFERED THROUGH THE SERVICE, WILL BE UNINTERRUPTED, SECURE, OR FREE OF ERRORS, VIRUSES, OR OTHER HARMFUL COMPONENTS, AND DO NOT WARRANT THAT THOSE ISSUES WILL BE CORRECTED. THE USER SHALL ASSUME ALL RISK FOR ANY AND/OR ALL DAMAGES THAT MAY RESULT FROM THE USE OR ACCESS BY THE USER TO CAMPUS X OR ANY OTHER THIRD PARTY ON CAMPUS X PLATFORMS.
4.
THE USER UNDERSTANDS AND AGREES THAT THE USER IS SOLELY RESPONSIBLE FOR ANY PROPERTY DAMAGE (INCLUDING BUT NOT RESTRICTED TO THE USER’S COMPUTER SYSTEM, MOBILE DEVICE, AND/OR ANY OTHER DEVICE USED TO ACCESS CAMPUS X OR ITS PLATFORMS), OR LOSS OF DATA OR ANY KIND OF PECUNIARY LOSS. THESE LIMITATIONS SHALL APPLY TO THE MAXIMUM EXTENT PERMITTED BY LAW.
Force Majeure
1.
Campus X shall not be liable for compensating inadequate performance of any obligations set forth in these Terms, caused due to force Majeure circumstances.
2.
Force Majeure circumstances include but are not limited to, acts of God, natural or industrial disasters, pandemics, acts of terrorism, power supply failures, civil disorders, military operations, equipment shutdowns, and/or other similar situations that cannot be reasonably foreseen or prevented.
Intellectual Property
1.
Campus X retains all right, title, and interest in all of Campus X’s intellectual property and all content, including but not limited to, inventions, ideas, concepts, domains, logos, trade dress, source code, discoveries, processes, marks, applications, methods, software, visual interfaces, graphics, information and data, and/or any other intellectual property rights associated with the Platforms of Campus X, whether or not patentable, copyrightable or protectable in trademark.
2.
Campus X does not claim any right over the marks and/or intellectual properties associated with any third parties on the Platforms and shall not attract any liability in any/all disputes arising from any use, abuse, or infringement of such marks.
3.
Campus X welcomes feedback, comments, ideas, and/or suggestions (“Feedback”) for improvement of the Platforms, and such Feedback may be communicated to Campus X directly. Campus X shall have an exclusive, perpetual, irrevocable, royalty-free, sub-licensable, and transferable license to use, copy, modify, create derivative works based upon or improvements with respect to such Feedback and otherwise exploit and commercialise the Feedback and any such derivative works and improvements in any manner and for any purpose. Campus X shall not owe compensation of any nature to the User for such Feedback.
Governing Law
1.
Use of Campus X and these Terms shall be governed by and construed in accordance with the substantive laws of India, without regard to conflict of law principles.
2.
If a lawsuit, court proceeding, or any similar Action is permitted under these Terms, the Users and Campus X agree to submit to the personal and exclusive jurisdiction of the courts of Delhi, India, for the purpose of litigating any dispute.
3.
However, Campus X retains the right to bring any appropriate Action or proceeding against the User, in the User’s country of residence or any other relevant country. The User acknowledges and agrees to waive any and all objections to the exercise of jurisdiction over the User by such courts and to the venue in such courts.
Dispute resolution and class action waiver
1.
The User may raise their dissatisfaction or complaints with the services provided by Campus X and its Platforms or seek dispute resolution, via correspondence with Campus X. Disputes raised shall be resolved by means of correspondence and negotiation between affected parties.
2.
The User waives off any/all right of class action lawsuit, class-wide arbitration, and/or in any other proceeding in which either party acts or proposes to act in a representative capacity shall only bring claims in an individual capacity.
3.
No arbitration or proceeding can be combined with another without the prior written consent of all parties to the arbitration and/or proceeding.
4.
Waiver of any/or all parts of the Terms shall be deemed a continuing or further waiver of any such part or any other part of the Terms, and the User’s failure to assert any rights or part of these Terms shall be deemed or otherwise constitute a waiver of such right or part.
5.
Any cause arising out of these Terms shall commence within one (1) year after the cause of action accrues. Otherwise, such cause of action is permanently barred.
Waiver of liability
1.
To the fullest extent permitted by applicable law, the User releases Campus X and its affiliates from responsibility, liability, claims, demands, and/or damages (actual and consequential) of every kind and nature, known and unknown (including, but not limited to, claims of negligence), arising out of or related to disputes between Users and the acts or omissions of third parties.
2.
The User expressly waives any rights that the User may have under any other statute or common law principles that would otherwise limit the coverage of this waiver to include only those claims that the User may know or suspect to exist in their favor at the time of agreeing to this waiver.
Notices and messages
The User agrees that Campus X will provide notices and messages to them in the following ways: (1) within the Service, or (2) sent to the contact information provided by the User. The User shall keep their contact information up to date.
Miscellaneous
Entire agreement
These terms contain all the terms applicable to the User, and supersede all other previous undocumented communication and representation and agreements.
Severability
If any clause here is declared unenforceable or invalid by law, then only such clause or part thereof shall be struck, and all the remaining provisions shall remain in full force and effect.
Assignment
Campus X may assign these Terms at any time to any entity without notice or consent to the Users. The User may not assign or transfer any of their rights or obligations under these Terms without the consent of Campus X.
Rights reserved
Campus X reserves the right to modify, update and/or change the Terms contained herein from time to time. Such changes shall be reflected in the Terms and Conditions of Campus X and continuing usage shall imply acceptance of the new Terms.

Specific terms and conditions apply to referral contests, which will be communicated separately.
